User Agreement (Terms of Use)

1. Introduction

This User Agreement (“Agreement”) governs your access to and use of the Refill Return mobile application and related services (the “App”), which provide information about locations offering free drinking water refills.

By downloading, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree, you must not use the App.

2. Purpose of the App

The App is designed to help users identify locations where free drinking water may be available for refilling reusable water bottles.

All information is provided for general guidance only and may not always be accurate, complete, or up to date.

3. User Responsibilities

You agree to:

  • Use the App only for lawful purposes

  • Verify information (including availability and opening hours) before relying on it

  • Respect the rules and property rights of listed venues

  • Not misuse, copy, or interfere with the App or its data

  • Not submit false, misleading, or harmful information

4. Accuracy of Information

We do not guarantee that:

  • Refill points will be available at all times

  • Information is complete, accurate, or current

  • Third-party locations will provide access without restriction

Use of information in the App is at your own risk.

5. Health and Safety Disclaimer

We do not guarantee:

  • Water quality, safety, or potability

  • Hygiene standards at listed locations

You are responsible for exercising your own judgment before consuming water from any listed source.

6. Intellectual Property

All intellectual property rights in the App are owned by or licensed to Ecosurety Ltd.

You may not copy, reproduce, modify, or reverse engineer any part of the App without permission.

7. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any loss, injury, or damage resulting from use of the App

  • We are not responsible for third-party locations or services

  • We are not liable for inaccuracies or service interruptions

8. Availability of the App

We may:

  • Modify, suspend, or discontinue the App at any time

  • Update or remove features without notice

We do not guarantee uninterrupted or error-free access.

9. User Data and Privacy (Including Advertising and Tracking Technologies)

We are committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

  • We process personal data as described in our Privacy Policy, which forms part of this Agreement.

  • Data collected may include:

    • Device and technical data (e.g. IP address, device identifiers)

    • Location data (where enabled)

    • App usage and interaction data

    • Information you provide

  • We use tracking technologies and third-party advertising tools, including TikTok Ads, Meta (Facebook/Instagram), Google Ads, and Apple Search Ads, to understand how users interact with the App and to measure advertising effectiveness.

  • These tools may collect data such as:

    • Ad clicks and engagement

    • App installs

    • In-app activity (e.g. feature usage)

  • This data may be shared with those platforms to:

    • Attribute installs and usage to campaigns

    • Measure and improve performance

    • Deliver more relevant advertising

  • Where required, we obtain your consent before using non-essential tracking technologies. You can withdraw consent at any time via device settings or in-app controls.

  • Location data is only processed with your consent and can be disabled at any time.

  • We do not sell personal data. Data shared with partners is subject to appropriate contractual safeguards.

  • We retain data only as long as necessary for operational, legal, and reporting purposes.

  • You have rights under UK data protection law, including to:

    • Access, correct, or delete your data

    • Restrict or object to processing

    • Withdraw consent

10. Termination

We may suspend or terminate your access if you breach this Agreement or misuse the App.

11. Governing Law

This Agreement is governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of its courts.

12. Changes to This Agreement

We may update this Agreement from time to time. Continued use of the App constitutes acceptance of any changes.
